Who we are

Pots&Feelings” (styled as “Pots&Feelings”) and “Potsandfeelings” both refer to the same service operated by [Company/Legal Entity Name], located at [Address]. Contact: [support@potsandfeelings.com].

By creating an account, using our website/app, or clicking “I agree,” you accept these Terms.

1) What we do (and what we don’t)

Pots&Feelings uses AI to suggest meals and food ideas based on mood and other inputs. We do not provide medical, nutritional, or psychological advice. Content is for information only and shouldn’t replace advice from qualified professionals. If you have a health condition, consult a professional before acting on suggestions here.

2) Eligibility & accounts

  • You must be 13+ (or the age of digital consent in your region) to use the service.

  • Keep your login secure; you’re responsible for activity on your account.

  • If you believe your account was accessed without permission, tell us right away.

3) Plans, billing, renewals & refunds

  • Some features require a paid plan. Prices, features, and limits may change.

  • Subscriptions auto-renew until you cancel. You can cancel in Account → Billing or via [support@potsandfeelings.com].

  • Our Refund & Cancellation Policy is part of these Terms and controls refunds: [link to Refund Policy].

  • Merchant of Record (MoR). If you purchase through a third-party MoR (e.g., Stripe, Lemon Squeezy, Paddle, Apple/Google), their terms and tax handling apply to checkout and refunds as required by them.

4) Acceptable use

You agree not to:

  • Break the law, violate rights, or attempt unauthorized access.

  • Scrape, crawl, or mass-harvest data without written permission.

  • Reverse-engineer or misuse our models, APIs, or security.

  • Upload unlawful, hateful, infringing, or deceptive content.

  • Use the service to claim medical outcomes or create harmful recommendations.

We may suspend or terminate accounts that violate these rules.

5) Your content & generated results

  • Your uploads/inputs. You keep ownership of content you upload or submit. You grant us a worldwide, non-exclusive, royalty-free license to use, host, process, and display that content to operate and improve the service (including model quality and safety), consistent with our Privacy Policy.

  • AI outputs. We grant you a non-exclusive license to use outputs for lawful purposes, subject to these Terms and any plan limits. You’re responsible for evaluating outputs before using them publicly or commercially.

  • Feedback. If you send ideas or suggestions, we can use them without restriction or payment.

6) Third-party services & links

We rely on third-party services (hosting, payment, analytics, support tools). Your use of those services may be subject to their terms. We’re not responsible for third-party sites we link to.

7) Beta features & changes to the service

We may offer experimental or beta features that can change or be removed at any time. We may modify, suspend, or discontinue features without liability, while making reasonable efforts to notify you of major changes.

8) Privacy

Our Privacy Policy explains what we collect, why, and your choices. It is incorporated into these Terms. Because mood/meal inputs can reveal sensitive preferences by inference, please review the policy carefully.

9) Intellectual property

The service, software, design, logos, and trademarks are owned by us or our licensors and are protected by law. You may not copy, modify, or distribute our IP except as allowed in these Terms.

10) Termination

You can stop using Pots&Feelings anytime. We may suspend or terminate your access if you violate these Terms, create risk, or for non-payment. After termination, your access to paid features ends. See our Data Retention section for what happens to your data.

11) Data retention & export

You can export your data from Account by contacting support. After cancellation, we may retain some data for 100 to let you export, or as required by law and for legitimate business purposes (e.g., fraud prevention, accounting). See the Privacy Policy for details.

12) Disclaimers

The service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant accuracy, reliability, or availability of any content or output.

13) Limitation of liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages; or for lost profits, revenues, data, or goodwill, arising from or related to your use of the service. Our total liability for any claim will not exceed the greater of (a) the amounts you paid to us in the 3 months before the claim or (b) USD $100.

Some jurisdictions do not allow certain limitations—if so, those limits apply to the maximum permitted.

14) Indemnity

You agree to indemnify and hold us harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the service, or your breach of these Terms.

15) Governing law & disputes

These Terms are governed by the laws of Delaware, USA, without regard to conflict of laws rules. Courts located in New York County, New York will have exclusive jurisdiction, unless you choose a different forum mandated by your local consumer law.

16) Consumer rights

Nothing here limits rights you may have under local consumer laws. If there is a conflict between these Terms and non-waivable consumer rights, the consumer rights prevail.

17) Changes to these Terms

We may update these Terms from time to time. We’ll post changes and update the “Effective date.” If changes are material, we’ll give reasonable notice (e.g., in-app notice or email). Continued use after changes means you accept the new Terms.
